Student Terms and Conditions

I (which expression includes any parent or legal guardian who has signed this agreement if I am under the age of 18 years) hereby accept an offer made to me by Study Group NZ Limited, a company incorporated in New Zealand (Company Number: 1012808, NZ Business Number: 9429037376802, Ministry of Education Number: 7459), trading as Taylors College (hereinafter referred to as “the College”) to enrol in the course(s) (hereinafter referred to as “the Course”) as indicated in the Letter of Offer (hereinafter referred to as “the Offer”).

The College agrees to provide educational instruction to me, from suitably qualified staff, in the subjects from the Course, conditional upon completing all required class work and written examinations and provided all fees owing are paid by the due dates.

I agree to pay to the College the tuition fees in accordance with the payment terms detailed in the Offer and, if I am taking out insurance through the College (clause 11), the cost of that insurance in accordance with the payment terms detailed on the College website. I further agree to pay all additional course fees and such other charges as may become payable to the College during the period of my enrolment, within fourteen (14) days of the issue of an account on behalf of the College for such fees.

I acknowledge that any variation of the terms and conditions of this agreement must be in writing and be signed by the College.

GENERAL MATTERS

1. I agree to comply with any directions reasonably given to me by a College staff member to maintain safety, good order and discipline.

2. I understand that:

(a) all lessons and any related materials supplied by the College are copyright and remain the property of the College; and

(b) any unauthorised copying may constitute a breach of the Copyright Act 1994.

3. I understand that I may be required to attend the College’s organised excursions and activities as part of the Course.

4. I authorise the College to obtain medical treatment for me should such action be deemed necessary by a College staff member. I agree to indemnify the College for any expense, loss, damage or liability of any nature occasioned as a result of authorising and arranging such emergency medical treatment.

5. I agree that I am responsible for my own books, equipment and personal items and I hereby release the College from all liability and claims for loss or damage to such items, howsoever caused.

6. I understand that I must notify the College in writing within seven (7) days if I change my contact details, accommodation type or residential address or there is a change to my emergency contact details or next of kin.

7. I agree that this agreement is intended to confer benefits on the College (for the purposes of the Contract and Commercial Law Act2017) and is legally enforceable as between the College and myself.

8. I confirm that the terms and conditions of this agreement have been explained to me.

9. I understand that if I successfully complete the Course of study set out in the Offer I will:

(a) be eligible to be awarded a New Zealand Certificate in Foundation Skills (Level 2) (Pre-Foundation programme only); and

(b) satisfy the minimum requirements for entry to the next course as outlined in my Offer.

VISA

10. I acknowledge that:

(a) this agreement is conditioned upon me obtaining the appropriate student visa to enable me to live and study in New Zealand;

(b) to obtain a student visa, I must be enrolled in full-time study;

(c) if I were a holder of other types of visas I should ensure my visa allows me to study in New Zealand;

(d) the College does not guarantee that I will be issued with a student visa;

(e) I am responsible for complying with all conditions relating to the student visa;

(f) I am responsible for providing a copy of the student visa to the Reception on Orientation Day;

(g) if I do not provide evidence of a valid student visa and/or the required contact details then, until that evidence is produced, I will be unable to attend my Course; and

(h) if I fail to obtain or maintain a valid student visa or am required to leave New Zealand for whatever reason, this agreement will be terminated (clauses 26-30) and I may be entitled to a refund (clauses 35-37).

INSURANCE

11. I acknowledge that:

(a) the Offer is conditional on me holding a valid insurance policy which meets the requirement of the Education (Pastoral Care of International Students) Code of Practice 2016 (hereinafter referred to as “the Code”) prior to my being formally enrolled in the programme;

(b) I must use the OrbitProtect International Student Prime (hereinafter referred to as “OrbitProtect”) insurance policy which meets the requirements of the Code and is provided through the College unless the College approves the use of an alternative insurance policy. Information on OrbitProtect insurance policy is available on the OrbitProtect website;

(c) I must provide the College with a copy of my insurance policy and, if my insurance policy is not in English, I must provide a declaration in written English that the insurance policy complies with the requirements in the Code;

(d) whether I use the OrbitProtect insurance policy or an approved alternative policy, at the time I take out the insurance policy I will need to disclose any medical condition I already have (hereinafter referred to as “Pre-existing Condition”);

(e) if I have a Pre-existing Condition I may need to pay an additional insurance premium so that my insurance will cover that Pre-existing Condition, or my insurance may not accept that Pre-existing condition;

(f) my insurance policy must be for the length of my student visa and include the periods during which I travel to and from New Zealand, even if that includes dates outside the period of the Course;

(g) there will be things that my insurance policy does not cover, which will be explained in my insurance policy;

(h) I will be responsible for any costs not covered by my insurance policy, including any costs relating to any Pre-existing Condition not covered by my insurance policy; and

(i) if I fail to obtain, or maintain, appropriate insurance my enrolment will be cancelled and I may become liable for deportation.

12. I confirm that I have been advised that:

(a) most international students are not entitled to public health services while in New Zealand; and

(b) the Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents and temporary visitors to New Zealand but I may still be liable for all other medical and related costs.

13. I acknowledge that if I receive medical treatment during my stay, I may be liable for the full costs of the treatment.

THE EDUCATION (PASTORAL CARE OF INTERNATIONAL STUDENTS) CODE OF PRACTICE 2016

14. I understand that:

(a) the College has agreed to observe and be bound by the Code.

(b) the Code sets required outcomes for the College to ensure that:

  • information supplied to students is clear, sufficient, and accurate;

  • the agents maintain high professional standards;

  • the recruitment of students is undertaken in an ethical and responsible manner;

  • students are provided with appropriate information prior to entering into any commitments;

  • contractual dealings with students are fair and reasonable;

  • any disciplinary action is taken in accordance with the principles of natural justice (clause 20);

  • all students have appropriate insurance coverage and visa for the duration of the Course;

  • a safe study environment is provided for all students;

  • adequate support is provided for the well-being of all students;

  • accommodation arranged by the College is safe, is in acceptable condition, and meets all regulatory and legislative requirements (clause 19);

  • students are fully informed about the relevant advice and services to support their educational outcomes;

  • fees paid by students for educational instruction are secure and protected in the event of student withdrawal or the ending of educational instruction or the closure of a signatory (clause 37); and

  • the College has fair and equitable internal procedures for the resolution of student grievances (clauses 40-44, 46) and is compliant with International Student Contract Dispute Resolution Scheme (DRS) Rules 2016 (hereinafter referred to as “DRS Rules”) (clause 47).

STUDENTS UNDER THE AGE OF 18 YEARS

15. The College will endeavour to obtain written agreement from the student’s parent(s) or legal guardian(s) before making any decisions affecting the student.

16. If the College cannot get a written agreement from the student’s parent(s) or legal guardian(s) before making decisions about the student (e.g. because a decision has to be made in an emergency), the College will inform the student’s parent(s) or legal guardian(s) about the decision as soon as practicable.

17. Students under the age of 18 years at the date of enrolment will not be entitled to enrol until the consent of their parent or legal guardian has been given to the College in writing and accommodation has been approved.

18. It is a requirement under the Code that any student, who is under 18 years of age, must live full time with either an approved residential caregiver or a designated caregiver.

DISCIPLINARY ACTIONS

20. I acknowledge that:

(a) if any issue arises in relation to my student conduct, the matter may be referred to the Campus Director of the College;

(b) if an issue arises in relation to my academic conduct (such as plagiarism or cheating), the matter will be referred to the Academic Committee of the College;

(c) the College may take appropriate disciplinary action in response to my conduct or behaviour in accordance with the Attendance Policy, Academic Conduct Policy, Student Conduct Policy, and other disciplinary policies, which are available on the College website; and

(d) any disciplinary action taken by the College will be consistent with the principles of natural justice. Those principles require the process to be timely, considered, and fair.

21. I acknowledge that the penalties that may be imposed on me for breach of a College regulation, rule or policy are:

(a) an oral or written reprimand;

(b) a direction that an incident of misconduct be recorded in the College’s Academic Committee records;

(c) a fine;

(d) a limitation or prohibition on attendance at any class or classes or the use and enjoyment of any of the College’s facilities;

(f) a temporary suspension from attendance in any class or classes;

(g) cancellation of my enrolment; and/or

(h) another penalty prescribed by a particular College regulation, rule or policy.

22. In addition to, or instead of, any of the above penalties I may be required to pay for damage to property.

23. The specific procedures that the College will follow in taking disciplinary action will depend upon the nature of my alleged conduct and are set out in the relevant regulations, rules, and procedures, including the Attendance Policy, Academic Conduct Policy, Student Conduct Policy, and other disciplinary policies.

24. I acknowledge that the Campus Rules for the campus(es) from which the College delivers the Course require me to comply with all New Zealand laws while on campus.

25. I acknowledge that it would be a breach of the Student Conduct Policy if I wilfully acted (either on campus or elsewhere) in a manner that would bring the College into disrepute. One way in which my actions could bring the College into disrepute would be if I broke New Zealand laws while off-campus.

CANCELLATION OF ENROLMENT / TERMINATION OF CONTRACT OF ENROLMENT

26. I understand that the grounds on which my enrolment may be cancelled post-arrival and this agreement may be terminated are set out in the College’s policies, including Attendance Policy, Academic Conduct Policy, Student Conduct Policy, and other disciplinary policies (clauses 20-25).

27. I acknowledge that the grounds on which the College may cancel my enrolment include:

(a) my failing to obtain, provide evidence of, or maintain a valid student visa or being required to leave New Zealand for whatever reason;

(b) my failing to provide contact details as required by the College and the Code prior to the commencement of and during my study;

(c) my failing to obtain, or ceasing to hold, the insurance cover I am required to hold under the Code (clause 11);

(d) my failing to pay my tuition fee and any other relevant fees in full by the due date;

(e) my failing to meet the required standard of class attendance;

(f) my enrolment being terminated as the outcome of a disciplinary process (clauses 20-25); and/or

(g) the College no longer being a signatory to the Code, ceasing to be a provider of education for international students or ceasing to operate a course (clause 37).

28. I may cancel my enrolment in the Course by:

(a) advising the Student Welfare Manager in writing of my intention to cancel my enrolment.

29. I understand that if my enrolment is cancelled either by me or by the College, this agreement will be immediately terminated except that the following policies will continue to apply and be enforceable after the termination of this agreement:

(a) Campus rules on property damage;

(b) Student grievance and complaints policy;

(c) Student withdrawal and refund policy (clause 36);

(d) Student privacy policy;

(e) Student fee protection policy; and

(f) Under 18 student policy on hand-over care.

30. I acknowledge that, if my enrolment is cancelled, the College will advise Immigration New Zealand if I am holding a student visa.

PAYMENTS

31. Payment can be made to the College using a number of payment options via the PayOnline platform. Access to this platform can be found at https://www.taylorsauckland.ac.nz/payonline using the unique student access code.

32. Certain payment options will carry a processing fee of 2.5%. The College reserves the right to alter this charge from time to time.

STUDENT FEE PROTECTION ARRANGEMENTS

33. The College operates a static trust (“Public Trust”) for the refund period and for accommodation fees, and a Bank Bond for the post withdrawal period. This arrangement has been accepted by the New Zealand Qualifications Authority (hereinafter referred to as “NZQA”) as meeting the requirements of the Education Act 1989 and the Student Fee Protection Rules 2013.

WITHDRAWAL AND REFUND POLICY FOR INTERNATIONAL STUDENTS

34. I understand that the College agrees to refund within five (5) working days and without deduction, all fees paid where the student produces certified evidence that the application made by the student for a student visa has been rejected by the New Zealand immigration authorities.

Refunds prior to the commencement of a course

35. I understand that the College agrees to refund within five (5) working days fees paid by or on behalf of the student, less the Enrolment Fee.

Refunds after the commencement of a course

36. I understand that the College agrees to refund within five (5) working days on the receipt of written notice of cancellation by the student (and parent or legal guardian if the student is under the age of 18 years) fees paid by or on behalf of the student less the amounts to be retained as detailed below.

(a) For courses of three (3) months or more:

  • If written notice of cancellation is received up to the end of the tenth working day after the start of the Course, the College may retain up to 25 per cent of total fees paid based on actual expenses incurred; or

  • If written notice of cancellation is received later than the end of the tenth working day after the start of the Course, there will be no refund of any monies paid.

(b) For courses of five (5) weeks or more but less than three (3) months:

  • If written notice of cancellation is received up to the end of the fifth day after the start of the Course, the College will retain 25 per cent of total fees paid; or

  • If written notice of cancellation is received later than the end of the fifth day after the start of the Course, there will be no refund of any monies paid.

(c) For courses under five (5) weeks:

  • If written notice of cancellation is received up to the end of the second day after the start of the Course, the College will retain 50 per cent of total fees paid. However, if two (2) days constitutes the full amount of the tuition paid for by the student, the College may retain 100 per cent of the payment; or

  • If written notice of cancellation is received later than the second day of the start of the Course, there will be no refund of any monies paid.

Courses closing or ending early

37. I understand that:

(a) should the College voluntarily close or cease to offer a course, pro rata refunds will be made to the affected students within five (5) working days from the date of closure or cessation, unless NZQA permits a longer period;

(b) should the College be given notice by NZQA of a course closure event, pro rata refunds will be made to the affected students within fifteen (15) working days, unless NZQA permits a longer period; or

(c) in the event of a natural disaster, NZQA may give notice for a course to be closed. Should this occur, a pro rata refund will be provided except when the course recommences before the start of the eleventh working day after the date of the notice.

WITHDRAWAL AND REFUND POLICY FOR DOMESTIC STUDENTS

38. The refund policy for domestic students is in accordance with Clause 235 of the Education Act 1989. For details, please contact the Bursar of the College.

STUDENT COMPLAINTS AND GRIEVANCE POLICY

39. I confirm that I have been advised that:

(a) The Code requires all institutions to have fair and equitable internal grievance procedures for students. It provides a framework for service delivery by educational providers and their agents to international students. It sets out the minimum standards of advice and care that are expected of educational providers with respect to international students;

(b) The Code applies to pastoral care and provision of information only, and not to academic standards;

(c) In the event of a dispute between me and the College, internal procedures are in place to facilitate the resolution of the dispute (clauses 40-44, 46);

(d) If I remain dissatisfied with the outcome of a dispute in relation to a contractual or financial issue, I may contact iStudent Complaints (clause 47); and

(e) If I have a concern about the behaviour of another student or, for College accommodation, a person with whom I am living, I can raise that concern with any College staff member.

Disputes about teaching and evaluation

40. If I have a complaint concerning the quality of the teaching provided by the College, the course materials, what I am or am not being taught, or my assessment, grading or evaluation, I can report the matter to the Director of Teaching and Learning of the College.

41. The complaint will be dealt with under the College’s policies, including the Academic Conduct Policy.

42. The first step will be to resolve the complaint informally, with either the staff in question or the Director of Teaching and Learning.

43. If I am dissatisfied with information resolution, or I don’t think an informal process is appropriate, I can make a formal complaint and an internal independent investigator will be appointed to investigate my complaint. An investigator will be required to complete the investigation in accordance with the principles of natural justice.

44. If I am dissatisfied with the outcome of an independent investigation. I can request a decision from the Campus Director.

45.If I am dissatisfied with the Campus Director’s decision, I may contact NZQA. This is detailed on the NZQA website.

Contractual and financial issues

46. If I have any queries relating to course fees and other charges payable to the College, those queries will be dealt through internal procedures by the College staff.

47. If I am dissatisfied with the decision of those staff, I may contact iStudent Complaints as part of the DRS Rules. This is an independent scheme that provides a free process for dispute resolutions. A copy of the DRS Rules is available on the New Zealand Legislation website and information on iStudent Complaints is available on the iStudent Complaints website.

INFORMATION ABOUT ME

48. I (which expression includes any parent or legal guardian who has signed this agreement if I am under the age of 18 years) give consent to:

(a) my photographs, videos, artwork or other works, as well as recorded or written testimonials and details of my achievements (hereinafter referred to as “Student Images and Testimonials”) being used by Study Group NZ Limited, or a third party agent of Study Group NZ Limited, worldwide for promotional purposes including in their printed and online marketing materials and on any social media network without further consent or notification; and

(b) Study Group NZ Limited storing, or transferring across international borders, copies of the Student Images and Testimonials for such purposes.

49. I authorise the release of information relating to my enrolment status to any other New Zealand tertiary education provider for the course or programme immediately following my completion of the Course to the College, and consent to the College using that information in printed and online marketing materials and any social media networks without further consent or notification.

50. I acknowledge that, if the College becomes aware that I have breached the terms of my student visa they are required to report that breach to Immigration New Zealand. This includes letting Immigration New Zealand know if I breach the terms of my student visa by failing to attend classes (other than for genuine reasons such as illness) or failing to make satisfactory academic progress.

INFORMATION PROVIDED TO ME

51. I have been provided with information on:

(a) the Code, available on the New Zealand Legislation website;

(b) the NZQA brochure on making complaints under the Code, available on the NZQA website;

(c) the DRS, available on the New Zealand Legislation website;

(d) the College’s Attendance Policy, Academic Conduct Policy, Student Conduct Policy, and other disciplinary policies, available on the College website; and

(e) the Student Handbook, available on the College website.

52. I have been provided with information on:

(a) the Course closing or ending early (clause 37);

(b) the most recent result of the external quality assurance report by NZQA, available on the NZQA website;

(c) the details of staffing, facilities, and equipment, available on the College website and the Student Handbook;

(d) the details of services and supports, how I can access them, and any additional charges for particular services or facilities, available on the College website and the Student Handbook;

(e) the estimated study and living costs while undertaking the Course, available on the College website;

(f) the options for accommodation while undertaking the Course, available on the College website and the Student Handbook;

(g) the general costs of transportation in Auckland, transportation options, leisure activities, and adjusting to New Zealand culture, available on the College website and the Student Handbook; and

(h) the relevant orientation programmes, available on the College website and the Student Handbook.

53. I have been advised that:

(a) information on entitlements to public health services is available on the Ministry of Health website;

(b) information on the New Zealand accident compensation scheme is available on the Accident Compensation Corporation website;

(c) information on visa and permit requirements and reporting is available on the Immigration New Zealand website; and

(d) information on rights to employment in New Zealand while studying as an international student is available on the Immigration New Zealand website.
